American Weekend Entertainment, Inc. (“AWE,” “we,” “us,” or “our”) owns and operates AWEinc.tv and related websites, pages, content, and services operated by AWE (collectively, the “AWE Services”).

These Terms of Use (“Terms”) govern your access to and use of the AWE Services.

By accessing or using the AWE Services, you agree to these Terms.

If you do not agree, please do not use the AWE Services.

1. ABOUT AWE

American Weekend Entertainment, Inc. is a music, media, entertainment, and marketing company.

AWE develops, owns, operates, supports, or participates in media properties, music-related initiatives, advertising and sponsorship programs, artist and brand partnerships, and related business activities.

Information presented through AWEinc.tv is primarily intended to provide information about AWE, its businesses, capabilities, properties, partnerships, and related activities.

2. MUSIC DAILY

AWE owns and operates Music Daily, including MusicDaily.com.

Music Daily provides music editorial coverage, artist discovery, interviews, videos, advertising, sponsorship experiences, promotions, and related media services.

Your use of MusicDaily.com and Music Daily-operated services is governed by the applicable Music Daily Terms of Use and Music Daily Privacy Policy.

Those terms, rather than these AWE Terms, govern your use of Music Daily Services where applicable.

3. SIGNL NETWORKS

AWE may work with Signl Networks, Inc. (“Signl”) in connection with artist, fan, advertising, sponsorship, technology, promotional, or other experiences.

Signl is a separate legal entity from AWE.

Certain artist pages, fan experiences, campaign features, registration services, and related functionality appearing within AWE-affiliated properties, including certain Music Daily pages or subdomains, may be operated by Signl.

Your use of Signl-operated services is governed by the applicable Signl Terms of Use, Signl Privacy Policy, and other Signl terms or disclosures presented in connection with those services.

The appearance of a Signl-operated service on an AWE-owned property does not make that service an AWE-operated service.

4. BUSINESS AND INFORMATIONAL CONTENT

The AWE Services may contain information concerning AWE’s businesses, media properties, capabilities, partnerships, advertising opportunities, sponsorship programs, industry perspectives, case studies, projects, and future plans.

This information is provided for general informational and business purposes.

Nothing on the AWE Services constitutes a binding offer, contractual commitment, guarantee, investment recommendation, financial advice, or representation that a proposed project, partnership, campaign, service, or business opportunity will be completed or made available.

Any business relationship with AWE is subject to the applicable written agreement between the parties.

5. INTELLECTUAL PROPERTY

The AWE Services and AWE-owned content, including AWE’s names, trademarks, logos, graphics, designs, text, photographs, videos, presentations, materials, and other content, are owned by or licensed to American Weekend Entertainment, Inc. and are protected by applicable intellectual-property laws.

AWE also owns certain brands and intellectual property associated with its media properties, including Music Daily, subject to any third-party rights or licenses.

Third-party artist names, photographs, music, videos, trademarks, logos, brand materials, and other content remain the property of their respective owners or licensors.

Except as expressly permitted, you may not reproduce, distribute, modify, publish, commercially exploit, or create derivative works from AWE-owned content without authorization.

6. PERMITTED USE

You may access and use the AWE Services for lawful personal, informational, and legitimate business purposes.

You may not:

  • Use the AWE Services for unlawful, fraudulent, deceptive, or harmful purposes

  • Attempt unauthorized access to AWE systems, accounts, networks, or data

  • Interfere with website security, availability, or operation

  • Introduce malware, malicious code, or other harmful technology

  • Use automated means to scrape, harvest, copy, or extract content or information except as expressly permitted

  • Impersonate AWE or another person or organization

  • Misrepresent an affiliation or relationship with AWE

  • Use AWE content, names, trademarks, or branding in a manner likely to cause confusion regarding sponsorship, endorsement, or affiliation

  • Violate AWE’s or another party’s intellectual-property, privacy, publicity, or other rights

7. SUBMISSIONS AND COMMUNICATIONS

The AWE Services may allow you to submit inquiries, business information, proposals, feedback, contact information, or other communications.

You represent that information you submit is accurate to the best of your knowledge and that you have the right to provide it.

Submitting an inquiry, proposal, business opportunity, or other communication does not create a confidential, fiduciary, agency, partnership, employment, or contractual relationship with AWE unless the parties separately agree in writing.

Please do not submit confidential, proprietary, or commercially sensitive information unless AWE has agreed in advance to receive that information on a confidential basis.

8. PRIVACY

AWE’s collection, use, disclosure, and protection of personal information through the AWE Services is described in the applicable AWE Privacy Policy.

Information collected through Music Daily or a Signl-operated experience may instead be subject to the applicable Music Daily or Signl privacy policy and any disclosures presented at the point of collection.

Please review the privacy notice applicable to the particular service or experience you use.

9. THIRD-PARTY WEBSITES AND SERVICES

The AWE Services may contain links to or information concerning independent third-party websites, platforms, companies, artists, agencies, advertisers, sponsors, social networks, streaming services, or other services.

AWE does not control independent third-party services.

Your use of third-party services may be governed by their own terms, privacy policies, and practices.

A link to or reference to a third party does not necessarily constitute AWE’s endorsement, sponsorship, or recommendation of that third party.

10. NO PROFESSIONAL OR INVESTMENT ADVICE

Content made available through the AWE Services is provided for general informational purposes.

Nothing on the AWE Services constitutes legal, accounting, tax, financial, securities, or investment advice.

Any statements regarding business plans, market opportunities, strategies, projections, partnerships, or future activities are informational only and should not be relied upon as guarantees of future results.

11. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AWE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

AWE DOES NOT WARRANT THAT THE AWE SERVICES WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, ERROR-FREE, COMPLETE, ACCURATE, OR SECURE.

AWE DOES NOT WARRANT OR GUARANTEE THE ACCURACY OR RELIABILITY OF THIRD-PARTY CONTENT, INFORMATION, PRODUCTS, SERVICES, OR WEBSITES REFERENCED THROUGH THE AWE SERVICES.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AWE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE AWE SERVICES.

AWE is not responsible for the acts, omissions, products, services, content, or representations of independent third parties.

Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded.

13. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless American Weekend Entertainment, Inc. and its officers, directors, employees, and agents from claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful misuse of the AWE Services, violation of these Terms, or infringement of another party’s rights.

14. MODIFICATION, SUSPENSION, OR TERMINATION

AWE may modify, suspend, restrict, or discontinue portions of the AWE Services.

We may restrict access where reasonably necessary to protect AWE, our systems, users, partners, intellectual property, or legal rights or to comply with applicable law.

15. CHANGES TO THESE TERMS

We may update these Terms periodically to reflect changes to our services, business practices, technology, or legal requirements.

Revised Terms will be posted with an updated “Last Updated” date.

Additional notice will be provided where required by applicable law.

Your continued use of the AWE Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

16. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

17. NO WAIVER

AWE’s failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.

18. GOVERNING LAW

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where applicable law requires otherwise.

GENE SICARD

EXECUTIVE IN CHARGE OF PRODUCTION

Gene’s experience brings an eclectic musical and production background to AWE. He trained as a classical musician and singer at the Manhattan School of Music, sang baritone with the New York City Opera, and later became a producer, composer and arranger for Atlantic Records.

Beginning in 1985, Gene owned and operated several production houses catering to major advertising and corporate clients. His musical training and experience has provided him with a finely tuned ear and great directorial expertise, which is reflected in his craftsmanship. Gene has a recognized style featuring strong creativity, high energy, and an emphasis on intricate production techniques.

EXECUTIVE DIRECTOR, LONG-FORM CONTENT

Ted is an accomplished entertainment executive with experience in start-ups, major-market station management, artist development and management, business and programming development. Having direct experience in the Traditional, Digital, On-site, Social, Mobile and ‘Cross-Platform‘ media business, he has created innovative solutions for competitive and technical challenges facing customers and strategic partners. Specializing in revenue development through building and maintaining excellent relationships with clients, vendors, and staff, while ensuring seamless communication between internal and external groups and all essential vehicles of content distribution.

Ryan is currently a Senior at SUNY Fredonia with a Major in Music Industry and a Minor in Communications. His goals are to get a job in the music industry either with live performances or social media.

Paloma Pimentel

I am Paloma Pimentel, I am bilingual and speak English and Spanish. I am a senior at college, a practicing communicator and journalist. I have been to 19 countries and have a multi-cultural understanding of people and societies. I hope one day to become a communications expert.

Mel is an accomplished media entertainment executive with over twenty five years experience in multimedia sales, management, production and distribution for both large scale companies as well as start up environments.

A strong hands-on professional, he has developed and activated marketing programs for many fortune 500 brands including Microsoft, Mercedes, L’Oreal, Hennessy, Citi, and Kraft while at companies like CBS Interactive Music, Clear Channel Interactive, National Lampoon, Tribune and iHeart Radio.

An early adopter of cross-platform and branded integrations, Mel has also executive produced programs for broadcast television and streaming web including South Side Johnny Live (NYE Special), ‘Cool Notes’ Jazz, Segway Music Countdown, and iHeart Radio’s Jingle Ball.
